HOUSE RULES
1. A 4 week Probationary period applies to all tenants.
2. No smoking is permitted in the bedroom or any other place where smoking could present a fire hazard.
3. Guests must refrain from doing any action which is likely to cause a fire. This includes using any heat generating articles such as a heating apparatus, cooking appliances or irons in guest rooms unless provided by Blue Lyrebird.
4. Guests are not permitted to bring any of the following onto the premises as they may disturb or endanger other guests:
3.1. Animals or birds of any kind except guide dogs or assistance dogs.
3.2. Gunpowder, oils or other explosives or flammable substances.
3.3. Objects emitting a foul odour.
3.4. Objects of an unusually large size or in unusually large quantities.
3.5. Firearms or swords or drugs or other articles whereby possession is prohibited by the laws of NSW.
5. Guests are not permitted to invite outside visitors to guest rooms.
6. All common areas will be closed at 10pm and we request you keep noise to a minimum to not disturb other tenants.
7. Laundry will close at 6pm sharp.
8. Guests cannot use the room for purposes other than lodging.
9. Guest rooms and shared living spaces cannot be utilised as an office space unless otherwise permitted by Blue Lyrebird.
10. All corridors and Fire Exits are to be clear at all times.
11. Rooms are to be left clean and in an orderly manner without any excessive clutter.
12. Gambling or other acts which are contrary to good morals, or which cause annoyance are strictly prohibited.
13. Rules regarding equipment and fixtures on the premises are as follows:
3.6. Guests must refrain from using equipment of fixtures for purposes other than those intended.
3.7. Guests should not take equipment and fixtures out of the premises. Removal or alteration of equipment or fixtures is prohibited including security cameras, sensors and sprinklers
3.8. Blue Lyrebird may refuse to accommodate a guest who behaves in a manner which causes physical or mental harm to other guests.
3.9. Please note that guests will be charged for any damage or loss of the Blue Lyrebird’s facilities or equipment.
14. Guests should use the safety deposit boxes for money and other valuables which are available free of charge at reception or in the room safe. Blue Lyrebird will not be liable for the loss or theft of valuables not put in safety deposit boxes.
15. Guests should be prepared to show their room key if requested by Blue Lyrebird agents.
16. Guests are required to pay relevant weekly advance rent by 12pm each Thursday.
17. Unclaimed articles, whether valuable or invaluable, shall be held for 30 days (including the day the item was found) unless otherwise specified. Articles which remain unclaimed after this period shall be discarded. Perishable items will be discarded immediately.
18. AFTER HOURS CALL OUT FEE of $50 will be charged per call out in the event of a lock out or any other reason requiring after hours assistance unless where the swipe card is deemed faulty.
TERMS AND CONDITIONS FOR ACCOMMODATION
1. PAYMENT
1.1. The guest agrees to pay on time as per Accommodation Contract .
1.2. Payment for accommodation includes utility charges for gas, water, electricity. wifi and bed linen.
1.3. Blue Lyrebird will provide a payment receipt to the guest and keep a record of accommodation fees paid under this agreement.
1.4. Accommodation charges shall be paid even if the guest voluntarily does not utilize the accommodation facilities once such facilities have been made available to him/her by Blue Lyrebird.
1.5. Weekly payments will be processed every Thursday morning by 12pm. Failing to do so may result in the termination of the Accommodation Contract.
2. USE OF THE PREMISES
The guest agrees:
2.1. not to use the premises, or cause or permit the premises to be used for any illegal purpose, and
2.2. not to interfere, or cause or permit interference, with the reasonable peace, comfort or privacy of neighbours or other guests, and
2.3. to use any common areas only for their intended purpose and be considerate of others who may need to use the same facilities, and
2.4. not to intentionally or negligently cause or permit any damage to the premises, and
2.5. not to cause or permit more people to reside in the premises than is permitted by this agreement, and
2.6. to keep the premises reasonably clean, and
2.7. to notify reception as soon as practicable of any damage to the premises.
3. CONDITION ASSESSMENT
3.1. A monthly room inspection may occur on the 1st of every month between 12pm-3pm where a condition report will be conducted by management to check maintenance or occupational health and safety issues. You will be advised of any inspections 2 weeks prior via email or letter to room.
3.2. If Blue Lyrebird becomes aware that the premises are subject to a significant health and safety risk, guests will be advised within 14 days that the premises are subject to the significant health and safety risk and informed of the nature of the risk.
4. URGENT REPAIRS/ CONTRACTOR VISITS
Should Urgent repairs be required, please contact reception or our 24/7 off-site service (02) 4782 9630.
Where General Repairs and Maintenance is required throughout the premises or in guest rooms we will try our best to give notice to guests where possible prior to works being done.
5. DAMAGE AND LOST PROPERTY
The guest agrees to:
5.1. pay for any loss or damage to the room or equipment in the room during the period of use excluding wear and tear.
5.2. compensate Blue Lyrebird for any damage caused through intention or negligence on the part of the guest.
5.3. pay a cleaning fee of $500.00 in the case that the room is left in an excessively dirty state.
5.4. return the keys for the room at the time of departure and to pay a charge of $50.00 for the replacement of each key the guest loses or fails to return.
5.5. Take responsibility for their belongings. Blue lyrebird is not responsible for the safekeeping of any valuables, goods, or vehicles that belong to guests and/or their guests, brought in or on to the rooms or grounds at any time.
5.6. The guest will not make any claim against Blue Lyrebird for any damage or loss to their goods or valuables, regardless of how, when or where the loss or damage occurred.
6. RIGHT TO CANCEL ACCOMMODATION
Blue Lyrebird may cancel this Accommodation Contract immediately without refund of bond or current weekly rent under any of the following cases:
6.1. When the guest is deemed liable to conduct and/or have conducted himself/herself in a manner that will contravene the laws or act against the public order and good morals in regards to this/her accommodation;
6.2. When Blue Lyrebird is requested to assume an unreasonable burden in regard to his/her accommodation;
6.3. When Blue Lyrebird is unable to provide accommodation due to natural calamities and/or other causes of force majeur. In this rare case full bond will be refunded.
6.4. When the guest seeking accommodation is deemed liable to behave in a manner that will infringe upon other guests of Blue Lyrebird or behaves in such a manner, due to intoxication or other causes.
6.5. When the guest does not observe the rules prohibiting certain actions specified under the House Rules.
6.6. When the guest does not comply with a payment request by Blue Lyrebird.
6.7. In the event you become Covid positive or have any other contagious disease you are to notify Management immediately. Tenants in shared ensuite rooms will need to relocate to an alternative location at the expense of the tenant until the Isolation period is completed as per NSW Health guidelines. Equeva Group will assist by offering a discounted rate at one of their properties on request.
6.8. Should the tenant wish to end this contract before the expiry date as listed on this contract 14 days written notice will be required via email to gm@equeva.com.au.
7. NO SMOKING POLICY
The guest rooms and all common areas within the building are non-smoking. The guest agrees to pay a cleaning fee of $500.00 per room should the guest or anyone else smoke in these areas. Please use designated smoking areas appointed outside the building only..
8. SMOKE ALARMS
The smoke alarms in the premises are hardwired. They are monitored on a monthly basis in accordance with our annual fire safety statement and replaced only by management where necessary.
9. FIRE ALARMS
The guest agrees that if a fire alarm is set off by his or her actions, or the actions of a member of the guest’s party, the guest will pay the call out fee charged by the NSW Fire Brigade which is currently $1950.00 per call out.
10. OBSERVANCE OF HOUSE RULES
The guest shall observe the HOUSE RULES established by Blue Lyrebird.
11. PETS
Guests are prohibited from keeping animals on the premises.
12. PRIVACY
12.1. The guest acknowledges that Blue Lyrebird have installed CCTV cameras in the car park and selected public areas. Recorded footage will not be provided to any other third party and will be discarded after 14 days.
12.2. Blue Lyrebird adheres to the National Privacy Principles relating to the collection of personal information.
12.3. Blue Lyrebird will make personal information available to third parties where required by law, or to enforce our collection of amounts owed by the guest.
12.4. Personal information collected during the guest’s stay will be retained for the length of time necessary to comply with taxation and accounting requirements.
